Don’t commit spoliation!

Yes. I spelled that right. Because we live in a litigious society, I need to share my company’s position on reformatting computer hard drives. This is an option when repairing a corrupted operating system or killing suspected malware. Cameron Park Computer Services no longer reformats hard drives. The potential exposure to accusations of spoliation is too great. I and my clients have never been hit with any accusation of spoliation. Seeing that I have been doing this since 1992, I better adopt this policy before the law of averages catches me.

What is “spoliation”? “Spoliation,” in simple terms, is the intentional destruction of data. If you had pictures on your computer that were illegal and you felt you could wind up in jail for possessing them, you might hire a computer guy. you would ask him to intentionally erase the pictures. If you get caught, both of you could face accusations of committing spoliation.
